1. Acceptance of Terms

By accessing or using FanaticFactory, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our platform.

2. Description of Service

FanaticFactory is a community platform that enables users to create, join, and participate in online communities ("Factories"). Our services include community management tools, discussion forums, event scheduling, and member engagement features.

3. User Accounts

To access certain features, you must create an account. You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Providing accurate and complete registration information
  • Updating your information to keep it current

4. User Conduct

You agree not to:

  • Post content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
  • Impersonate any person or entity
  • Interfere with or disrupt the platform or servers
  • Attempt to gain unauthorized access to any portion of the platform
  • Use the platform for any commercial purpose without our consent
  • Collect or store personal data about other users without their consent

5. Factory Ownership

Factory owners control their Factory and, when they publish a paid offer, act as the seller responsible for that offer and its fulfillment, subject to laws that may assign duties differently.

  • Moderating content within their Factory
  • Setting and enforcing community guidelines
  • Ensuring compliance with applicable laws
  • Managing member access and permissions
  • Describing paid products accurately and delivering courses, downloads, event admission, and membership benefits as promised
  • Publishing support and refund information and responding to buyer requests promptly

6. Payments, Fees, and Payouts

FanaticFactory facilitates payments through Stripe Connect. The buyer pays through FanaticFactory checkout, the Factory owner receives seller proceeds in a connected Stripe balance, and FanaticFactory retains the platform fee shown in the owner’s Sales settings. Stripe processing, currency-conversion, tax, dispute, refund, and other payment costs may also apply.

FanaticFactory uses a controlled payout schedule rather than sending every sale directly to a bank. Eligible proceeds are released automatically on the published payout schedule after processing availability, delivery or event holds, reserves, refunds, disputes, negative balances, and risk reviews. Bank arrival timing remains subject to Stripe and the owner’s financial institution.

7. Purchases, Access, Cancellations, and Refunds

A completed one-time purchase of a course, download, or event ticket belongs to the purchasing account. Leaving or being removed from the Factory does not by itself remove that purchase from Purchases. Access may be suspended while a payment dispute is open and restored if the dispute is resolved in the Factory owner’s favor. Access may end after a full refund, payment reversal, successful dispute, legal requirement, fraud or abuse finding, or removal of the user’s FanaticFactory account.

Paid memberships provide access only while the subscription entitlement remains usable. A member who cancels normally keeps access through the paid billing period. If an owner bans a member and blocks access immediately, FanaticFactory also cancels recurring billing immediately; any selected refund is handled separately.

Factory owners set the buyer-facing refund-request window and policy. FanaticFactory provides the request and Stripe refund tools, may issue automatic refunds when delivery fails or a paid event is cancelled, and may act when required by law, payment-network rules, fraud prevention, or platform policy. Refunds, disputes, chargebacks, and related losses may be deducted from seller proceeds, reserves, the connected Stripe balance, or future payouts.

8. Sales Tax, VAT, GST, and Seller Reporting

Factory owners must determine where their sales create registration, collection, filing, remittance, invoice, and recordkeeping obligations; keep their Stripe Tax business details, product tax category, and registrations current; and obtain professional tax advice for the places where they sell. When configured, Stripe Tax calculates and collects transaction tax using the connected account’s registrations.

This contractual allocation does not override applicable law. Marketplace-facilitator, deemed-supplier, digital-platform reporting, payment reporting, or similar laws may place collection, remittance, withholding, information-reporting, or seller-verification duties on FanaticFactory. When they do, FanaticFactory may collect or remit tax, request seller information, withhold amounts, issue or facilitate tax forms, and change the payment flow as needed.

9. Content Ownership

You retain ownership of content you create. By posting content, you grant FanaticFactory a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content on the platform.

10. Intellectual Property

The FanaticFactory name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of FanaticFactory. You may not use such marks without our prior written permission.

11. Termination

We may terminate or suspend your account at any time for any reason, including violation of these Terms. Upon termination, your right to use the platform will immediately cease.

12. Disclaimer of Warranties

The platform is provided "as is" without warranties of any kind. We do not guarantee that the platform will be uninterrupted, secure, or error-free.

13. Limitation of Liability

FanaticFactory shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the platform.

14. Changes to Terms

We reserve the right to modify these terms at any time. We will notify users of significant changes via email or platform notification.
